The U.S. Department of Commerce’s Bureau of Industry and Security (BIS), Office of Strategic Industries and Economic Security (SIES) is assessing the U.S. Active Pharmaceutical Ingredient (API) industrial base. BIS utilizes the Defense Production Act of 1950 (DPA), as amended, to both collect and protect the business proprietary information submitted by the survey respondents. Additionally, Executive Order 13603 delegates the authority to assess the capabilities of the U.S. industrial base to support the national security and critical program needs and develop policy recommendations to improve the international competitiveness of specific domestic industries to the Department of Commerce.

Your organization has been identified as part of the API industrial base in the United States. Your organization’s participation is vital to ensure a comprehensive dataset for the assessment. BIS has worked in successful partnership with industry in the past and we anticipate similar cooperation from you on this effort. The assessment will support U.S. government policymaking by increasing understanding of the use, sourcing, and capabilities of domestic API production, enhancing U.S. health security and preparedness.

If your organization was contacted by BIS, your organization is required by federal law (50 U.S.C. § 4555) to complete the U.S. API industrial base survey. All information submitted to BIS is protected as Business Confidential under provisions of the DPA of 1950, as amended. Data submitted in response to this survey is restricted from public release. Public disclosure of identifiable information collected via this survey requires the specific determination from the President, Secretary of Commerce, or Under Secretary of Industry and Security that withholding this information is contrary to the interest of the national defense. Survey response information is protected from release following Freedom of Information Act (FOIA) requests.
