License exceptions

A license exception is an authorization described in part 740 of the EAR that allows you to export or reexport, under stated conditions, items subject to the EAR that otherwise would require a license. This page provides helpful information when using specific license exceptions.

License Exception Notification Advanced Computing (NAC)

License Exception Notification Advanced Computing (NAC) (see Section 740.8 of the EAR) requires a prior notification to BIS as described in Section 740.8(a)(2) of the EAR. The following are additional guidance when submitting a NAC notification via SNAP-R: 

  • SNAP-R Work Item Type:
  • Exporters select ‘Export License Application’
  • Reexporters select ‘Re-Export License Application’
  • Block 9 Special Purpose: enter “NAC”
  • Block 18 Ultimate Consignee and Block 19 End-User: Only one ultimate consignee and one end user is allowed.  Notifications which include more will be returned without action.  A distributor may not be a party to the NAC notification.
  • Block 22 Export Item: The NAC notification is limited to six items. BIS recommends limiting the notification to one model number per notification.  

You can track the NAC notification progress in STELA. If your NAC notification is approved, you will receive a NAC authorization number (Axxxxxx) to be used in your AES filing. 

License Exception Implemented Export Controls (IEC)

License Exception Implemented Export Controls (IEC) (see Section 740.24 of the EAR) authorizes exports, reexports, and transfers (in-country) to, among, or within specified destinations whose governments have implemented equivalent technical controls on several semiconductor, quantum, and additive manufacturing items. Eligible items and destinations are incorporated by reference and available at www.bis.gov/iec.
